Terms and Conditions

Welcome to Patriot Listings, the website of Patriot Listings, LLC. ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our platform and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform.

1. Nature of the Platform

Patriot Listings is a platform designed to connect users for the purpose of buying, selling, and trading goods and services, including but not limited to 2nd Amendment-related items such as firearms, ammunition, and accessories. We are not a firearms dealer, and we do not participate in nor are we a party to the sale or transfer of any of the items listed on the Platform. We are not a seller, buyer, or intermediary in any transactions between users. Our role is solely to provide a venue where users may connect with one another. We do not facilitate, oversee, or participate in the sales or exchanges that occur between users, nor do we verify the quality, legality, or safety of any goods or services offered.

2. No Liability for User Content or Transactions

We are not responsible for the content posted by users on the Platform, including its accuracy, legality, or appropriateness, nor for any discriminatory actions or decisions made by users in their interactions or transactions. Likewise, we are not liable for the outcomes of any transactions, interactions, or disputes that arise between users, including claims of discrimination or refusal to engage based on protected characteristics. As a platform, we do not endorse, guarantee, or assume responsibility for any goods, services, or actions of users. In accordance with applicable safe harbor laws, such as the Communications Decency Act and the Digital Millennium Copyright Act, we are not liable for user-generated content. While we reserve the right to remove content that violates these Terms or is otherwise objectionable, we do not review or monitor content before it is posted.

3. User Responsibility and Due Diligence

Users are solely responsible for their own actions and interactions on the Platform. This includes, but is not limited to:

  • Ensuring compliance with all applicable federal, state, and local laws and regulations, particularly those governing the sale, purchase, possession, and transfer of firearms, ammunition, and related items.
  • Verifying the identity, trustworthiness, and legal eligibility of other users with whom they interact.
  • Conducting their own due diligence to ensure that any transactions they enter into are lawful, safe, and meet their expectations.

We strongly encourage users to exercise caution and perform thorough research before engaging in any exchange or transaction through the Platform. Patriot Listings does not provide legal, financial, or transactional advice, and users assume all risks associated with their use of the Platform.

4. User Conduct

To maintain a safe and lawful environment, users must adhere to the following rules:

Prohibited Actions:

  • Listing or attempting to sell any illegal firearms or modifications or stolen goods.
  • Engaging in transactions that violate federal, state, or local laws.
  • Posting false, misleading, or deceptive information.
  • Using the Platform for any unlawful, fraudulent, or malicious purpose.
  • Posting or sharing illegal, harmful, offensive, or misleading content.
  • Engaging in fraudulent, deceptive, or abusive practices.
  • Violating the intellectual property rights of others.
  • Harassing, threatening, or intimidating other users.
  • Attempting to hack, disrupt, or gain unauthorized access to the Platform or its systems.

We reserve the right to investigate and take appropriate action, including account suspension or termination, against any user who violates these Terms or engages in conduct we deem harmful to the Platform, other users, or third parties.

5. Intellectual Property

All content on the Platform, excluding user-generated content (e.g., listings, posts, or messages), is the property of Patriot Listings or its licensors and is protected by copyright, trademark, and other intellectual property laws. Users retain ownership of the content they post but grant Patriot Listings a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content as necessary to operate and promote the Platform. Users must not post content that infringes on the intellectual property rights of others.

6. Account Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms.
  • Conduct that we believe is harmful to other users, the Platform, or third parties.
  • Suspected fraudulent or illegal activity.

Upon termination, your right to access or use the Platform will cease immediately. We are not liable for any losses or damages resulting from account termination.

7. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by posting the updated Terms on the Platform or through other reasonable means. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

8. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the Platform will be resolved through binding arbitration in Utah, conducted in accordance with the rules of the American Arbitration Association. You agree to waive any right to pursue disputes through a class action lawsuit or class-wide arbitration. This clause does not apply to claims involving intellectual property rights or small claims court matters within their jurisdictional limits.

9. Accessibility

We strive to make Patriot Listings accessible to all users, including those with disabilities. If you have difficulty accessing any part of the Platform due to a disability, please contact us at support@patriotlistings.com to report the issue. We will make reasonable efforts to address accessibility concerns, though we do not guarantee full compliance with all accessibility standards, such as the Web Content Accessibility Guidelines (WCAG), at all times. Accessibility features may evolve as we continue to improve the Platform.

10. Geographic Restrictions

Patriot Listings reserves the right, at its sole discretion, to restrict access to the Platform from certain geographic regions, including but not limited to the State of California, for any reason, such as compliance with local laws, operational considerations, or business strategy. Users attempting to access the Platform from restricted regions may be blocked, and we are not obligated to provide service to individuals in those areas.

11. Governing Law

These Terms and your use of the Platform are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any legal action not subject to arbitration will be brought exclusively in the state or federal courts located in Utah.

12. Limitation of Liability

To the fullest extent permitted by law, Patriot Listings, LLC., its officers, directors, members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses related to transactions, user interactions, content posted by others, or claims alleging discrimination, lack of accessibility, or failure to accommodate specific user needs. The Platform is provided on an "as-is" and "as-available" basis, and we disclaim any warranties regarding uninterrupted access, error-free operation, or compliance with all accessibility or anti-discrimination requirements beyond what is required by law.

13. Indemnification

You agree to indemnify and hold harmless Patriot Listings, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
